ELIGIBILITY: The Square Enix Members Rewards Program ("Program”) is subject to these terms of participation ("Terms of Participation”). The Program is open to legal residents of the United States who are the legal age of majority in their country of residence or 18 years of age (whichever is older) and eligible to create an Account in accordance with the Square Enix Store Terms of Sale. If you are under the legal age of majority in your jurisdiction or under 18 years of age (whichever is older), your parent or legal guardian must consent to these Terms of Participation on your behalf. By participating in the Program, you agree (i) to these Terms of Participation, the Terms of Sale, Square Enix’s Terms of Service and Privacy Notice (each, incorporated by reference); and (ii) to the decisions of Square Enix ("Square Enix,” “we,” “us,” and “our”), which are final and binding in all respects. If you do not agree and consent to these Terms of Participation, please do not participate in the Program.
Capitalized terms used but not defined in these Terms of Participation shall have the meanings given to them in the Terms of Sale.
HOW TO BECOME A MEMBER: To become a member ("Member”) of the Program, visit https://na.store.square-enix-games.com/rewards ("Website”) and follow the directions to create an Account. You may only create one Account for yourself (including your children if you are the parent or guardian of children under the age of majority in their jurisdiction or 18 years of age, whichever is older). If you sign up for multiple accounts or attempt to create multiple accounts by script, macro, or other automated means, your accounts will be void and you will not be eligible to participate in the Program.
HOW TO EARN POINTS: Once a Member, you can earn points by participating in various activities, which may be updated from time to time and will be set forth via your Square Enix Members account, and may include creating an Account, purchasing Products on the Store, and following Square Enix’s social accounts (collectively, “Eligible Activities”). We reserve the right to add, modify, and/or discontinue any Eligible Activity and/or modify the number of points associated with any Eligible Activity at any time and for any reason. We will post any changes to the Website, or via your Square Enix Members account, or notify you by email when we make any changes.
The points you earn will be deposited in your Account, and your point deposit and new balance will be accessible through your Account. Any points earned by purchasing Products on the Store will be credited to your Account only when we accept your order and confirm your purchase in accordance with the Terms of Sale. We reserve the right to deduct any points or rewards awarded for an Eligible Activity, including if your Store order is canceled or reversed. An order may be canceled or reversed according to the Terms of Sale, including for any orders returned, refused, or refunded, if we are unable to process the payment method you provided, and for any fraudulent activities. Please inform us immediately of any discrepancies in your point balance. We will make any adjustments in our sole discretion. Our decisions with respect to the number of points accumulated are final and binding.
POINT CONDITIONS/EXPIRATION:
BENEFITS AND REWARDS: All rewards offered in connection with this Program will be set forth in your Square Enix Members account. From the Square Enix Member accounts, click on https://na.store.square-enix-games.com/rewards for a current list of reward items. A reward may be limited in number and will be provided on a first come first serve basis. Once a reward item has been depleted, no more of the item will be given. Any material terms and conditions associated with redemption of a reward, including, but not limited to, use or purchase limitations, limited availability, or limited promotional period(s), will be set forth on the Website. All reward item details are at our sole discretion. You cannot transfer, substitute or redeem points for cash. We reserve the right to substitute a reward of comparable or greater value, at our sole discretion. Rewards are provided “as is” with no warranty or guarantee, either express or implied. You are responsible for all federal, state, and local taxes, customs fees, if any, as well as any other costs or expenses associated with a reward which may be specified on the Website (e.g., shipping fees). Rewards are considered taxable income and are subject to federal, state, and local taxes, including income and withholding taxes. If you are a U.S. resident, when the value of the reward items for which you redeem points reaches US$600 or more in a calendar year, a 1099 tax form will be generated and mailed to you for tax reporting purposes. We recommend that you keep all account statements sent to you when you redeem points for reward items for record keeping purposes. We do not accept and disclaim any responsibility for any tax implications that may arise from the rewards or your use thereof. You are solely responsible for any tax filing obligation or any tax payment due to any authority as a result of the rewards you receive. It is your sole responsibility to seek independent advice on the possible implications this may have on your own financial situation.
GENERAL: These Terms of Participation may be modified at any time, and the Program and any information regarding the Program may be modified, suspended, or discontinued, in whole or in part, at any time. Any changes will be effective when we notify you of such changes either by posting the new terms on the Website or by emailing you. By participating in the Program after being notified of a change to these Terms of Participation or the Program, you agree to be bound by such updated terms. We encourage you to review these Terms of Participation periodically to ensure familiarity with the most current version. You can check when these Terms of Participation were last updated by checking the "Last Revised" date at the top. All questions or disputes regarding the Program, including without limitation, those involving eligibility, participation, fraud, and abuse will be resolved by us in our sole discretion.
By participating in the Program, you agree, to the maximum extent permitted by applicable law, (i) to release, discharge, indemnify and hold harmless Square Enix, its parent, subsidiaries, affiliates, retailers, and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees and agents (collectively, “Released Parties”) from any liability or damages which may arise out of participating in the Program or the use of any reward. All applicable federal, state and local laws and regulations apply. To the maximum extent permitted by applicable law, Released Parties are not responsible for late, lost, incomplete, delayed, inaccurate, garbled, or undelivered points, reward requests, rewards, or other errors or problems of any kind relating to or in connection with the Program, whether printing, typographical, technical, computer, network, human, mechanical, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Program, the tabulating of points, the announcement of the reward items or in any Program-related materials. Persons found tampering with or abusing any aspect of this Program, who are acting in a disruptive manner, who interfere with others’ participation in the Program, or who are otherwise not in compliance with these Terms of Participation will be disqualified and all points will be void. Released Parties are not responsible for injury or damage to Members’ or to any other person's computer or other device related to or resulting from participating in this Program or downloading materials from or use of the Website, Store, or any other Square Enix website.
The Program is not valid in combination with any other programs offered by Square Enix. The Program is void outside the jurisdictions listed in the "Eligibility” section and is void where prohibited by applicable law.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms of Participation, or yours and our rights and obligations in connection with the Program, shall be governed by, and construed in accordance with, the "Governing Law and Venue” and “Dispute Resolution” sections of the Terms of Sale.
PERSONAL INFORMATION: Your personal information collected in connection with this Program will be used in accordance with our Privacy Notice.
